Generally speaking, in catastrophic injury cases, the greatest obstacle is helping you meet that threshold injury requirement of it being a general injury to catastrophic injury. Once you can support with documentary evidence and proofs that this is a catastrophic injury, something greater than, in most states, something that’s greater than $250,000 or more, then it’s a whole new ball game, basically. Now the insurance companies have to take you more seriously. They have to go and basically put into reserves more money to compensate the individual that’s seriously injured.

So proving the degree of your injury is generally speaking the biggest hurdle that you have to face when you’re dealing with catastrophic injuries because not everything is black and white. You know, death, yes, it’s catastrophic; spinal cord injuries, yes, catastrophic. But if you don’t look it sometimes, but you are it based on the injury that you sustained, then it’s your lawyer’s job to prove that.
