The answer to that question is yes, you can still recover in New Jersey, but in New Jersey, we we’re a comparative fault
state. So, you have to be 50% or less at fault. Think of it like a scale. If
you’re 51% at fault and the other person is 49% at fault, you recover nothing. If it’s
50/50, fine. or if you’re less than 50% fine, but you can’t be more than 50% at fault in order to recover for bodily injury in New Jersey.
