We settled the case for $11 million and it involved a spinal cord injury on a young man. And what happened was a cement truck driver fell asleep at the wheel and went off the freeway and crashed into a car that was on the side of the road waiting for a tow truck. That part of the case was straightforward. What was the challenge on the part was showing that the company that hired that truck and called them an independent contractor so he didn’t have to be responsible for what he did on the road was really his boss in that they had so much control over what that cement truck driver did that they were responsible for it. So we spent three years on that case taking probably 70 depositions, sworn statements getting to the bottom of that business practice and what they did. And at the very end, right before trial we were able to get that settlement for our client and we feel very good about that.
Los Angeles, CA personal injury attorney Thomas Johnston talks about a case where a man was severely injured as his car was hit by a cement truck. He shares that he settles a case for $11 million involving a spinal cord injury to a young man. A cement truck driver fell asleep at the wheel, veered off the freeway, and crashed into a car waiting for a tow truck. That part of the case is straightforward. The real challenge lies in proving that the company hiring the truck—labeling the driver as an independent contractor to avoid liability—was effectively his employer, since they exercised so much control over the driver’s actions. Over three years, he takes roughly 70 depositions, gathers sworn statements, and investigates the company’s business practices. Just before trial, he secures the $11 million settlement for his client, leaving him confident and satisfied with the outcome.
