The most memorable case I’ve been involved in was on the heels of the .com bust in the early 2000s. I’d represented a contractor that had made some improvements to a downtown building and we’d received a judgement, but the building owner couldn’t pay us and I knew the building owner well and I knew the building owner’s attorney well and it turned out that they had had a tenant that had not paid them and in fact they had built a 40,000 square foot improvement on top of their parking garage for that tenant. Ultimately, we decided to take an assignment of that claim for my client and we took that case to trial and we received an $11 million verdict, $5 million of which were punitive damages. We received all of our attorney’s fees and we were able to represent other landlords throughout the country that had had the same kind of treatment by the same tenant probably in 20 or 30 other leases.

He knew both the owner and the owner’s attorney well, and soon discovered that the problem stemmed from one of their tenants—who had failed to pay rent after the owner had constructed a 40,000-square-foot addition atop a parking garage specifically for that tenant.

Recognizing an opportunity, he arranged for his client to take an assignment of the owner’s claim against the tenant. They pursued the case at trial and won an $11 million verdict, including $5 million in punitive damages, along with full recovery of attorney’s fees. The victory not only vindicated his client but also opened the door to representing numerous other landlords across the country—roughly twenty to thirty of them—who had suffered the same kind of mistreatment from that same tenant in other lease agreements.
