Philadelphia, PA commercial litigation attorney Stanley Cheiken talks about the biggest challenges faced in business divorces. He notes that one of the greatest challenges litigants face in a business divorce is ensuring that they emerge from the process with a viable business. It is relatively easy to dissolve a company, divide the assets, and leave the parties with little more than a modest payout but no ongoing enterprise. However, that outcome is rarely ideal. His approach in a business divorce is to position the owners so they are in a stronger place than when they began. While this goal can often be achieved through negotiation and resolution, there are cases where the most effective course of action is to proceed to court and secure a decisive win.
