Previously, some attorneys hesitated to pursue these cases due to limited understanding by judges and juries, but today, robust medical documentation and evidence allow these cases to be presented effectively to a jury.

He notes that the field of TBI law is expanding and becoming increasingly well understood, a trend likely to continue. Traumatic brain injuries vary widely, from severe cases involving obvious trauma, such as skull fractures or intracranial bleeding, to milder cases classified as “mild traumatic brain injuries.” Despite the term “mild,” these injuries—which may involve short-term confusion, loss of consciousness, or a dazed state—can produce lasting effects.

He highlights the value of advanced diagnostic tools, such as diffusion tensor MRI (DTMRI), which can objectively detect shearing or tearing of axons and neurons in the brain. This technology provides critical evidence in cases where previously there was little objective proof of injury, strengthening the ability to advocate for clients effectively.
