The process for obtaining asylum requires that the refugee file a petition, an application and during that timeframe they have to prove that they were persecuted, that they’re in fear because of either past persecution or a reasonable fear of future persecution. Now during that time that individual has to be persecuted because of one of five things. It can be their race, it can be their religion, it can be their nationality, it can be that they’re a member of a particular social group, or ultimately, their political opinion. If an individual can show that they’re persecuted or have a reasonable fear of persecution on account of one of those five grounds they can qualify for asylum in the United States.

Miami, FL immigration attorney Ruth Jean explains the process for obtaining asylum. She remarks that the process for obtaining asylum requires that the refugee submit a petition and an application. During this period, she must demonstrate that she has been persecuted or that she has a well-founded fear of future persecution.

The persecution must be based on one of five protected grounds: race, religion, nationality, membership in a particular social group, or political opinion. If she can show that she has been persecuted or reasonably fears persecution on account of one of these grounds, she may qualify for asylum in the United States.
