Spousal support is dealt with in two
different phases in the dissolution
process. When a case first gets filed, a
spouse can seek uh temporary spousal
support and that really is meant to
maintain the status quo during the
dissolution proceeding. So that spouse
needs to show that they have a financial
need for spouse support while the
divorce is ongoing. Then when we get to
the latter phase of the case, the court
can order what is called permanent
spousal support. That determination is
based on a variety of factors detailed
in family code 4320 which look at the
income of both party, their obligations,
the other financial assets that they
have available to them. Domestic
violence perpetrated against one spouse
can also come into consideration um as
well as variety of other factors. So,
it’s a case- specific determination that
is made.
