00:04
admiralty in maritime is so specialized
00:07
because it comes from english law so
00:11
the english courts were set up
00:14
in a bunch of different ways you had the
00:15
king’s court the church’s court
00:18
and then you had the admiralty law
00:20
courts and the reason why those were set
00:23
up
00:24
was because the english learned pretty
00:26
quick
00:27
that if another country
00:30
didn’t appreciate
00:32
the laws
00:34
and would recognize that they would be
00:37
treated fairly they wouldn’t go to your
00:39
port
00:40
so when we became the united states as a
00:42
country we utilized english law and
00:46
recognize the importance of keeping the
00:48
admiralty separate
00:50
from other areas of law because it is so
00:53
specialized and because it does have to
00:55
essentially
00:57
blend in with the laws of other
00:59
countries so that in fact admiralty in
01:01
maritime law
01:03
in the united states follows the laws of
01:07
many other countries
01:08
because it has to be uniform and that’s
01:11
to make sure that
01:13
people in the maritime industry feel
01:15
comfortable
01:16
that they’re going to be treated fairly

Miami, FL admiralty & maritime attorney Michelle Otero Valdés explains why admiralty and maritime law have become so specialized. She notes that admiralty in maritime law is highly specialized because it originates from English law. In England, courts were structured in multiple ways—the king’s court, the church’s court, and the admiralty courts. The admiralty courts were established because the English realized that if other countries did not recognize and respect their maritime laws, they would avoid English ports. When the United States became a country, it adopted English law and maintained the separation of admiralty law from other legal areas due to its specialized nature. Admiralty law also needs to align with the laws of other countries to ensure consistency. As a result, U.S. maritime law follows international principles to provide assurance to those in the maritime industry that they will be treated fairly, just as they would be in other countries.
