You’re options are that you better probably call somebody like me because unless you take some action to pursue your claim, you’re unlikely to convince the other side. Now the way the question is asked, if you say it’s the employer you have to understand that work comp involves the injured worker against the employer and their workers compensation insurer, so there are two parties on the other side of the equation. The fact that an employer says it’s not work related is actually irrelevant. They have to submit a report of injury within 10 days from notice of the injury. Their insurance carrier then has 14 days to determine if its work related and they’re going to pay the claim. So we usually focus on what the insurance company says as to whether they’re going to accept liability because they’re the ones who typically make that ultimate decision.
