An injured worker is required to report their injury within 180 days from the occurrence of the injury or within 30 days if the employer can show that that failure to report caused them prejudice. Generally, the courts have applied the longer period of time the 180-day requirement, but having said that, we always counsel our clients or prospective clients who are simply calling us for advice that they should immediately report their injury. Again, that just assists the employer in processing the claim in a timely fashion and eliminates any question of whether this really happened on the job or not. The sooner you can report the injury the higher likelihood there is of it getting covered and not having to hire someone like me. The second reason is that it’s very important then to seek medical attention after an injury is reported. And to see a doctor and to get a diagnosis serves two purposes: get better and get back to work or document that the injury occurred just in case later on there is a dispute about how it happened.
