If you have a trust, you probably still should have a will. The trust instrument if drafted properly will allow your property to pass to its intended individuals if you have, in fact, transferred it into the trust, which is a separate issue. But you should also have a will for two reasons. One, to ensure that if you fail to transfer something into a trust that it will be disposed of properly and with your wishes, but also, to name the individuals that will be in charge of your estate should there be assets that are not in trust. Custodial’s, if you have children or trust issues these individuals will be named in a will that may not be named in a trust.
