RICO is a racketeering and influence corrupt organizations act. It was originally designed to go after organized crime; you know what we think of as the mob or the mafia. Increasingly it’s used to go after a number of individuals that the government has in their sights where five or more individuals agree and engage or attempt to engage in unlawful criminal organizations or activities. Prosecutors love it for the same reason they love conspiracy because what one person does can create exposure for another person once there is an agreement at the outset if you’re in for a penny you are in for a pound. In other words, oversimplified in a RICO allegation just as in a conspiracy allegation you do not have to be aware of exactly what your co-conspirator or you co-defendant is doing at all times to be held ultimately criminally responsible for it. So that’s why prosecutors love to pursue RICO allegations and conspiracy allegations.
