Cops can’t just willy-nilly pull anybody over. Field sobriety checkpoints or drunk driving checkpoints are not constitutional in Minnesota. Cops have to have what’s called reasonable suspicion of criminal activity, or oftentimes in DWIs, it may be a traffic infraction. They may stop somebody for speeding or going over the center line. And then they’ll approach the vehicle and try and see if there’s levels or indicators of intoxication to expand the encounter further.
