The nature and extent of the benefits that you would be entitled to under the worker’s compensation act is obviously very fact-specific.  But there is general categories of benefits that you may be entitled to.  The first is wage-loss benefits.  You could be entitled to wage-loss benefits for the time you miss from work or from time where you’re working less at work.  And that would be determined – the amount of that benefit is determined by your average weekly wage, what you earned in the 26 weeks before your injury.

The second type of benefit is rehabilitation benefits.  And that – those types of benefits aren’t money that would be paid to you, but that get paid out to a qualified rehabilitation specialist or QRC.  And they help you kind of navigate the waters.  The big benefit that all the insurance companies are concerned about now is medical benefits.  Those benefits can get very expensive and that’s the benefit that is sometimes the most valuable.  Because worker’s compensation benefits stays with you for life.  So as long as you’re treating for your work injury, that medical benefit is something that you have.

Those are the general worker’s compensation benefits.  There are other things that you might be entitled to, like permanent total disability benefits, if your doctor thinks that you’re unable to return to work because of your work injury forever.  Or retraining benefits, money to go to school and try to be retrained in a profession that you can do now in your injured condition.

Minnesota Workers’ Compensation attorney, Dana Gerber, discusses workers’ comp benefits and which ones you are entitled to.
