Truck vs Car Accidents

Truck drivers, and especially over the road truck drivers, are subject to regulation, and some might argue considerable regulation, both by the state and the federal government, and they’ve got to abide by hours on the road requirements or limitations, load limitations. Their vehicles are subject to inspection by commercial vehicle inspectors. And that’s all, I think, in recognition of the obvious, that they’re big pieces of machinery, often loaded, trailers loaded with tens of thousands of pounds of weight, and when they become involved in a crash, especially at highway speeds, very bad things happen. People die and people are maimed. And so while the trucking industry may claim that they’re overly regulated or highly regulated, I think it’s more than justified.

When a crash occurs with a semi tractor-trailer, for instance, on almost every occasion a commercial vehicle inspector is dispatched to the site in addition to state troopers or other peace officers to assure that that truck was in proper working order, that brakes were working and hooked up, that the driver had a log book identifying how long they had been on the road so they weren’t operating the truck when they were exhausted. So those are the kinds of things you see in a trucking accident that you might not see in a motor vehicle accident.

Minneapolis personal injury lawyer Jim Carey discusses how truck accident cases are different than accidents with other types of vehicles.
