When you’re dealing with an age claim it’s a bit more complicated than dealing with other types of discrimination claims. And so, age claims are tricky. The employee is older and so in almost all scenarios they’re making more in salary. And so, there is this difficulty in proving an age claim that if an employer wants to use the defense that they want to reduce expenses and they don’t do it as a broad based policy, they’re not firing every single older person in the business what you need to do is you need to document as you go along any comments that have been made by anyone in authority in the company about their biases.

Or you know, I’ve had cases where the supervisors have said we need new blood. I’ve had cases where there have been jokes made about the age of an employee. If you document those effectively and contemporaneously or in other words, at the time that they occur then you’re going to have a record and an opportunity to prove that age discrimination claim in a way that it may be difficult if you just have a hunch that you’re being discriminated against due to your age.
