An employer doesn’t have to take someone back to work under the workers compensation laws and I get that question a lot. An employer should take someone back if they can provide them with work within their physical restrictions, but there’s no claim I can file as a work comp lawyer that forces an employer to take someone back within their restrictions. Now, there are laws under the Americans with Disabilities Act, a federal law and laws under the Minnesota Human Rights Act, a state provision that mandates that employers accommodate disabilities across the board people with various restrictions or disabilities. So oftentimes, what we will do is if we see an employer that wrongfully refused to bring someone back to work, we will refer them over to one of our colleagues who handles exclusively employment law issues for a review of that particular situation.
