The key thing I want to leave my students understanding is that there is a real difference between the trial court and the appellate court. There is a real difference in the practice between the trial court and the appellate court. If you go to the appellate court utilizing trial court rules, it’s like playing baseball using football rules, you can’t do it. It’s a different way of presenting a case, it’s a different with the standards and the scope. So that’s what I’m hoping to leave my students with, is an appreciation of the difference between the two and what the appellate court does versus what the district court does and why the lawyer has to adjust himself or herself for the difference in their audience.
