The first thing I recommend an insurance company subrogation department do upon receiving a new claim that has subrogation potential is retaining an attorney. No matter the dollar size of the claim whether it’s a small residential claim up to a multimillion dollar loss it’s really important to get that attorney retained first. That attorney can assist in the process of placing parties on notice and scheduling and coordinating a loss inspection should one be needed. And the attorney usually will handle cases, at least in our office on a contingency fee basis. Which means that there is an incentive for that attorney to push that case forward and resolve it as quickly as possible. They don’t want to continue to draw out the process.
