There are a number of steps along the path to acquiring a patent and one of those, of course, is preparing and submitting an application for a patent. And the patent document itself is an application and it’s a sizable document to describe all the different clever nuances and sets forth the boundaries and includes figures to help you understand what the contents really amounts to. So it’s an application of this document and then there’s a number of iterations that quite likely will take place with the patent office whereby the examiner at the patent office says I’m not persuaded or maybe they say yes, this is sufficiently clever let’s give you a patent. And so there’s this back and forth negotiations in the form of prosecution that quite commonly occurs. And then at the end of that process, hopefully, the applicant has established a set of claims that are allowable and the applicant receives a notice of allowance. Shortly thereafter a fee is paid it’s called the issue fee and then the patent is granted after a number of months following the payment and issue fee.

Minneapolis patent lawyer David Black discusses the many steps it takes to acquiring a patent.
