When we start talking about a stepparent adoption one of the first factors is the biological parent still involved and normally we would not consider those with an involved biological parent. When in this case let’s just say the father, is the father of the child paying child support, is he visiting? If you have those scenarios it’s not likely that a courts going to grant them. Most of the stepparent adoptions that I do are agreed where one parent is agreeing to relinquish their right and the stepparent is agreeing to adopt. And it’s when you get into a contested argument that it becomes trickier. It’s hard to terminate parental rights when there’s not an agreement.
