I’ve had that happen at different times and I think sometimes the other spouse is afraid of the vulnerability that’s necessary or helpful in a collaborative divorce. And so then, what I do is I try to work very hard with the other attorney to use the same skillset knowing that we want to get to resolution. And that the truth is we never want to call that first witness unless we absolutely have to because if we’re calling a witness we’re tearing the flesh of that family. And quite frankly, as lawyers, we are trained to do that and that is not helping people.

Dallas, TX Family Law Attorney, Barbara Cole, explains what you should do if your spouse won’t do a collaborative divorce.
