special needs planning is one of the
00:06
most rewarding areas of our practice
00:08
it’s basically a subset of estate
00:10
planning because it is a type of estate
00:12
planning
00:12
and it’s a type of estate planning that
00:14
we do to help families who have a member
00:17
that has special needs and may need
00:18
special benefits in the future
00:21
and the case that i’m thinking of that’s
00:22
memorable to me is a family who had
00:25
a an adult child he was a young man
00:27
early 20s
00:29
he had cerebral palsy and he was
00:30
quadriplegic completely non-verbal so
00:33
entirely dependent on his family
00:35
and on medical care and amazingly to me
00:38
i had never seen this before
00:39
one of the medications he needed
00:41
required a pump
00:42
because he was completely unable to
00:44
swallow pills or even swallow liquid
00:46
medicine
00:47
medicine had to be pumped in and this
00:48
particular pump had to be filled with a
00:51
liquid medicine
00:52
that cost six thousand dollars a month
00:54
to fill
00:56
and there’s a medicaid benefit that
00:57
would help with that but medicaid
00:59
benefits require special
01:00
eligibility requirements and this
01:02
particular person
01:04
had a medical malpractice settlement
01:06
because a doctor had made some mistakes
01:09
and the insurance company wound up
01:10
paying some money it was a significant
01:12
amount of money to help care for this
01:13
person but it was not enough to care for
01:15
the person for the rest of his life
01:17
so we were able to take that money put
01:19
it into a special needs trust so that he
01:21
got the benefit of it
01:23
but also making it so that it didn’t
01:24
count as an asset for medicaid
01:26
eligibility purposes
01:28
so we could still get the help on a
01:29
monthly basis paying for that
01:31
six thousand dollar per month for the
01:33
rest of his life
01:34
medication and that doesn’t even count
01:36
all the other medications and nursing
01:38
help that he needed
01:39
so it was particularly memorable to me
01:41
because it made a huge difference when i
01:43
was able to look that family in the eye
01:45
across the table and say
01:47
i’ve got a solution we can make this
01:49
work we can make sure that your son
01:51
always has the medicine that he needs
01:53
the relief that washed over their face
01:55
was just amazing and it made me feel
01:56
really good about
01:57
being able to help a family that truly
01:59
needed it
