So, what if the other party offers you their NDA to sign? And that’s a situation that you have to treat a little bit carefully. It may be that there’s nothing wrong with their NDA, but because NDAs come in different degrees of strength – you know, some might treat nondisclosure of information; some might treat non use of information; some might create actual license, implied license provisions that you might not be aware of – you really need to recognize that when you get an NDA from another party, that that requires consulting with the legal department and really examining whether it’s suitable for the situation that you are about to enter into.
