Normal retirement under case law at the current time is 65 that coincided with the commencement of full Social retirement benefits and that case is several years old. Old and now most Social Security retirement benefits begin in full at age 67 but right now, the current law is normal retirement is 65.

If you retire before that you run the risk of continuing to pay whatever spousal maintenance you’re paying through age 65. You can retire early but you may not avoid paying permanent spousal maintenance at the same level you were paying before you retired. If it’s a long term marriage with a dependent spouse it’s very likely that spousal maintenance will continue through retirement so the age of retirement and retirement itself does not necessarily mean spousal maintenance is going to stop.

Minneapolis family law attorney Denis Grande discusses retirement after divorce.
