15 is a provision that’s been in the
statute for quite some time and I’m not
sure I’ve never done any legislative
history to determine why the legislators
in Illinois decided to put this in there
and it was never really used but it’s a
provision that allows a deconversion of
the building from a condominium building
back into fee simple ownership so for
example if you had a 200 unit
condominium building
and someone successfully pursued a
section 15D conversion
they are essentially removing the
condominium declaration from the county
recorder’s records and deconverting the
building from Condominiums back into fee
simple ownership which merges the
building which is personal property into
the underlying fee which creates 200
apartment units versus 200 condominium
units
Chicago, IL business attorney Glenn L. Udell discusses Section 15 of the Illinois Condominium Property Act.
