Trends in HOA Laws

In terms of trends, I think that there is a move in Minnesota to standardize what homeowner association governance looks like. Minnesota has for over 20 years now had a state law that applies to all newly created common interest communities. But what I think we’re seeing now as the older common interest communities catching up opting into that statute, adopting new governing documents that apply to that. And then, of course, there’s the things you always see in HOAs, confusing issues regarding maintenance, problems with insurance claims, getting fair value for an insurance claim, problem homeowners. As long as there will be homeowners associations there will be those few homeowners that just don’t want to play by the rules and don’t care about how their neighbors think or feel.
