A residential construction contract in Minnesota has some very, very, very specific statutory requirements, whether – we have a statute, 327-A, which specifically limits any limitations you can place on liability; it requires specific notice requirements. There’s a notice now you have to give, related to radon. There’s dispute resolution provisions. There are a whole number of provisions. You have to provide a standard, for example, on what the basic construction standards are.

So, from a residential standpoint, there are a myriad of statutory requirements. And if you’re a builder and you don’t do those, you’re in big trouble. So, it’s a minefield for residential construction builders. They need a lawyer to help them with that contract, and if they don’t, they’re going to have trouble. So, that’s a starting point for all residential builders: they need to – now, fortunately, there’s forms out there that the Builders Association of the Twin Cities has developed – we work with them – and that’s a good place to start. And then, we help them customize their contracts.

Minneapolis business attorney Stephen Yoch of Felhaber Larson discusses statutory requirements that must be considered when drafting residential construction contracts.
