That’s a complicated question because there are a number of claims that are available to somebody with a construction defect. If it’s a negligence claim, you generally have two years from the date you knew or should have known about the problem. It’s that should have known piece that gets people in trouble. So perhaps they’ve had a window leaking for years the construction defendants will use that, if they can, as evidence that they should have brought their lawsuit earlier. So it’s very, very important if somebody thinks they have a problem they start investigating to make sure they either do or do not have a problem. There are other claims that are available such as breach of contract. There you have to look at the contract involved. Minnesota also has a statutory new home warranty and a statutory warranty on repairs so you have to look at those warranties to decide when you need to bring your claims. It’s always important in any sort of problem situation that you consult with a lawyer so you understand your timeframes before they are gone because once they’re gone, they’re gone, and you may just be left funding the repairs yourself.
