It depends upon the view of the law in each jurisdiction. There are some states that consider certain things assets that other states don’t. Like I said, I noted that there are times when states will be more over encompassing including assets. Some states are more restrictive in assets. Again, New York is based upon separate property and marital property, assets acquired during the marriage, with certain exceptions. I know Kansas is a unified property state that everything gets divided.
