I think there’s a great misunderstanding about cryptocurrency by members of the public and by lawyers in general. I’ve given a number of lectures on cryptocurrency in divorce and I’ve written a Law Review article about it. And the point I try to get across to the lawyers when I’m lecturing on this topic is cryptocurrency is just another form of money. It’s just another form of currency so you would divide it the same way you would divide a bank or an investment account. You either divide it in kind i.e., each marital partner gets the same number of cryptocurrency units whether it’s bitcoin or anthurium or something else. Or you place a value on it as of a particular day and give the other spouse an offsetting asset. The problem that does come about with cryptocurrency especially recently here is the market is so volatile that the value can fluctuate dramatically from day to day.
