Well, and estate going through probate can remain open for almost an unlimited amount of time. The things that need to be accomplished before probate can be concluded would be gathering the assets, determining if there’s tax consequences, both estate tax, inheritance tax and income tax to the decedent, filing those tax returns, and then distributing the property to the beneficiaries with them signing what’s called a refunding bond. Once those are all completed you can close out the probate, but that can take any amount of time, depending on the complexity of the estate.

Nutley, New Jersey estate planning and probate attorney, Brad Micklin, discusses an estate going through probate.
