I prepare for an oral argument by reviewing in detail the appellate briefs which have been filed. I review the case law that’s been cited. I review the district court record. And then I prepare for what I want to tell the appellate court but frankly appellate oral argument is not so much about what I want to say but it’s the questions that the appellate court has of me. Appellate oral argument is great because it is the only time you get to address the decision maker face to face answering the questions that concern the appellate courts. So large time in my preparation is used thinking about what concerns the appellate court about my client’s case.
