One of the benefits of these post-grant proceedings through the American Invents Act is that the challenger of a patent has the ability to rapidly challenge the patent even as shortly as immediately after issue. So what would happen in a case of a patent that’s being challenged is that instead of taking the time to perform an entire patent litigation which can take a number of years, patent challenger can tee up a post-grant review and have a reading of the patentability of those claims in roughly one to one and a half years. What that will do is force the patent owner to consider whether the claims that they issued are adequate or not for purposes of their patent infringement suit, and potentially have to go back to the office to correct them, or fix things that are problematic with the patent.
