Well, when I first started to practice in the dark ages, mothers had the right to custody and fathers had to beg for custody. In fact, I remember the first case I had representing a father in a custody case. And I walked into the courtroom and the judge looked at me and said, “Mr. Rounick, are you really coming in here asking me to give custody to a father?” But that was way before the time of the Equal Rights Amendment.
Right now, the father has the same rights as the mother. And it depends on what’s in the best interest of the child. That’s the test, not what’s in the best interest of the mother or what’s best interest of the father, but what’s best interest of the child? And that’s the standard.
