Preparing for a deposition is important. Very few cases actually make it to a jury to decide. Most cases can be resolved short of the expense and time of a trial, which means that the deposition sometimes may feel like the clients day in court. It’s very important to prepare a client to testify in his or her deposition and that’s a time intensive process. It’s also a process that a lot of lawyers try to shortcut, usually to the client’s detriment. So I will sit down with the client in my office, explain to them the strategy of answering questions in a deposition, go over all the facts so that there’s no surprises for the client, go over all the documents, and make sure that they are familiar with the record. That’s not something that you can leave to a client to do on his or her own. I feel it’s my duty to sit down and make sure the client is prepared because a mistake in a deposition can have big consequences in the rest of the litigation for the client.
