Nancy Golin, who was severely developmentally disabled and autist, was taken to a psychiatric hospital for a 72-hour hold under state law. Ultimately, the court decided that she should be placed in a conservatorship under the auspices of the state because the court found that, unfortunately, Nancy’s parents just were not suitable caretakers since Nancy needed 24-hour care 7 days a week. After Nancy was ordered by the court to be taken away from the care of her parents the parents sued everyone involved. That included the hospital and it also, unfortunately, included the police officer who decided for Nancy’s safety that she should be placed under a 72-hour hold, and evaluated at an appropriate medical facility.
