So if the other driver hits you or forces you off the road or for some other reason you become involved in a motorcycle crash and it’s somebody else’s fault, that person can look to you and say, “I can understand how you broke your leg and I can understand why your ribs are fractured and I can understand maybe why you have back problems, but that closed head injury that you have, and maybe the post-concussive symptoms that you might have, I get to tell the jury that if you wore a helmet you wouldn’t have many of those things, and that’s a defense to the claims that you might bring.” So the answer is yes, but they can raise that issue in front of the jury.
