I give my clients a lot of advice but
00:06
the one piece of device I give a lot is
00:09
to become engaged in the process of
00:11
estate planning when especially a
00:12
husband and wife come in we’re
00:14
representing the couple and usually one
00:16
is very vocal and the other is quite
00:18
quiet and it’s important that I draw
00:22
both of the couple into the conversation
00:24
and it’s hard for people to imagine the
00:26
situation when they’re incapacitated or
00:28
dead and I’m doing trust planning that’s
00:30
implemented at a time when they can’t
00:33
act the ability of me to give them a
00:37
beautiful document that works in the
00:39
circumstances and will continue on for
00:41
decades after they’re gone I can’t do it
00:45
without their involvement and so I want
00:47
them to ask questions I want them to go
00:49
home and think about issues that I asked
00:51
them to discuss who is going to be the
00:54
trustee who’s going to be the Guardian
00:55
to raise your children what advice would
00:57
you give that guardian or trustee all
00:59
these things can may and up in the
01:02
document but at the very least they can
01:04
be in letters or instructions so that
01:06
when the client is not around or able to
01:09
function their wishes are carried out
01:11
and the more the client gets engaged the
01:15
better the document is you know the
01:18
trust really they help when a client’s
01:22
gone to protect the assets and to give
01:25
guidance to the assets and when we’re
01:28
not there as people that are creating
01:31
trusts our words are there and what we
01:34
want is there and that document is
01:36
living on as a representation of the
01:38
person I know that beneficiaries put
01:41
weight into the documents they think
01:43
that the client really meant a lot of
01:46
the stuff in there when really it’s just
01:48
a preference of a lawyer about what they
01:50
what they usually put in a model
01:52
document so it’s important if the
01:55
beneficiaries are gonna think it’s what
01:57
you want that you get engaged in it and
01:59
you call the lawyer on things the
02:02
lawyers put in there why is that there
02:04
shouldn’t it be this and and then it
02:06
becomes a fun process and then when it’s
02:08
done you feel very comfortable about it
02:11
because it’s not a mystery
02:12
cumin you know what’s in there and it
02:16
also makes it more rewarding for me
02:19

02:22
