The most important thing in the medical malpractice cases is that before we even get a case put into suit, we have to get an expert onboard, a medical expert who is of a similar background of the other doctor that did something wrong or the other provider, whether it’s a nurse or whatever. We need that expert support that says you did something wrong. And in chat sites and blogs and articles and things like that, you have people that are giving their opinion, but they may not be the people giving their opinion that would be considered a comparable expert against this other doctor.

So a lot of times, you are on a chat site and everybody’s talking about, oh my gosh, I have the same symptoms or the same reaction. And the reality is, is that we can’t take that forward. It has to be medically supported. And the way that medical malpractice works is that we have to get an expert that says it’s more probably than not, meaning that it’s greater than 50 percent that what happened to you shouldn’t have happened. It’s more probably than not that this doctor treated you incorrectly.

So they have to testify to a reasonable degree of medical certainty on what happened with the care that you received. Obviously when you’re on blog sites and things like that, you’re not necessarily talking with the experts in that field.

Minneapolis medical malpractice attorney Shannon Carey explains what a patient should do if they think they have a medical malpractice claim.
