Medical negligence can happen where, again, the doctor treats the patient below the standard of care. However, there’s not a permanent residual damage. So it is a little bit different than medical malpractice. We use the words interchangeably, but malpractice is when there is a cause of action that can happen. Sometimes the doctor can be negligent, but if there’s no damage or no harm, then there’s no claim that you can pursue legally.
