It’s very case specific. It’s a hard question to answer. I don’t know that I can just give a general answer.

I think when you consent to treatment, or you can consent to something, you need to really understand what you’re consenting to. I think that’s the most important advice I could give a patient is really understand it, and if you don’t understand it even though things get hurried in the medical community, and they think, okay, the doctor’s seen it a thousand times just I’ve seen my retainer agreement a thousand times, but I need to slow down because this person that I’m talking to has never seen it before, just a doctor or a clinic or a nurse needs to slow down when they’re giving the consent forms.

So it’s really important to not feel pressured to sign something or agree to something if you don’t understand it, so I don’t think I really answered your question because it’s really case specific. But I think just in general the consent form you really need to make sure you understand what you’re consenting to.

Minneapolis medical malpractice attorney Shannon Carey discusses the challenges of consent forms.
