Medical malpractice is when you have a patient who has a relationship with a medical provider, a doctor, a nurse, hospital who, during that care, there is something that goes wrong. And the doctor owed the client what we call a duty or a responsibility to provide them the right care. However, the care that they chose to provide or that they did provide fell below the standard of care that’s out there.
There’s a standard that doctors have to abide by when treating a patient with whatever they’re dealing with and that falls below the standard of care. Then, as a result of that, the client suffers significant permanent residual damage. That means something that they’re permanently damaged going forward. They have a change of lifestyle that is pretty significant to them going forward. Those are the two elements that you have to have.
The other most important element is that we have to be able to prove that the doctor’s treatment that was below the standard of care caused that permanent damage that the patient suffered. The causation piece is always the hardest piece, is to be able to link those two together.
