Judges and their law clerks are very busy. The courts are overflowing with litigation these days and when you want a court to make a decision in your clients favor on something that’s going to affect the outcome of litigation or even the procedures in litigation, it’s important to keep your audience in mind. These are experienced judges but very pressed for time. My job in preparing a motion and the supporting papers is to cut through the noise and the atmospherics in the case and get to both the controlling law and why a decision in favor of my client is the right result.
