That they’re going to mediation with the idea that they’re there to reach a compromise. I always tell parties if everyone leaves the mediation a little bit unhappy it’s probably a good mediation. It’s unheard of that a party is going to leave a mediation believing that they got everything they wanted. And the same holds true that no one is going to leave a mediation feeling like they lost. And so I think it’s really important for lawyers to understand and to encourage their clients to be thinking about compromise, that that’s really the only way that a case is going to reach resolution.
