Mediation: What role do you play in Mediation?

I am a trained mediator and I also volunteer for the Los Angeles Superior Court as a volunteer mediator. I do my best to help the parties bridge the gap when they face an impasse and they just don’t know how to get to the next step. Sometimes it means looking past that impasse directly to the next step and then circling back. And by then sometimes the issue is resolved. I try to remind parties how much they stand to lose if they don’t resolve their cases amicably.

If a mediation falls apart and the case moves closer to trial, there is a lot of exposure on both sides. The biggest is obviously attorney’s fees. A trial can cost hundreds of thousands of dollars between the parties. And simply that could devastate an estate. Further, each party has a certain amount of exposure with regard to certain issues, whether it be financial support, division of assets. If you resolve a case amicably, if you can reach a resolution, you are in command of those decisions. If you leave it to a court to decide, you never know what’s going to happen.

Los Angeles, CA family law attorney Ron Reitshtein talks about his role as a mediator and the benefits of the mediation process. He explains that as a trained mediator and volunteer mediator for the Los Angeles Superior Court, my goal is to help parties overcome impasses and find a way to move forward. Sometimes this involves looking beyond the immediate impasse and focusing on the next steps, which can lead to a resolution. I emphasize to the parties the potential losses they may face if they fail to reach an amicable resolution.

When a mediation fails and the case moves closer to trial, both parties are exposed to various risks. One of the major risks is the accumulation of attorney’s fees, as a trial can incur significant costs, potentially leading to financial strain. Additionally, each party faces exposure regarding issues such as financial support and division of assets. By resolving a case amicably, the parties retain control over these decisions. However, if they rely on the court to make the decisions, the outcomes become uncertain.
