I am a trained mediator and I also volunteer for the Los Angeles Superior Court as a volunteer mediator. I do my best to help the parties bridge the gap when they face an impasse and they just don’t know how to get to the next step. Sometimes it means looking past that impasse directly to the next step and then circling back. And by then sometimes the issue is resolved. I try to remind parties how much they stand to lose if they don’t resolve their cases amicably.
If a mediation falls apart and the case moves closer to trial, there is a lot of exposure on both sides. The biggest is obviously attorney’s fees. A trial can cost hundreds of thousands of dollars between the parties. And simply that could devastate an estate. Further, each party has a certain amount of exposure with regard to certain issues, whether it be financial support, division of assets. If you resolve a case amicably, if you can reach a resolution, you are in command of those decisions. If you leave it to a court to decide, you never know what’s going to happen.
