Late payments in workers compensation are something that is, I don’t want to say is common but because of what we do professionally we see it a lot. Most insurance company payments are timely but many are not. And when they’re not it could give rise to a penalties claim. And there are penalties provisions in the work comp law that allows an injured worker to file a claim for late payments, negligent payments, intentional underpayments, and there’s a variety of different percentages of what that payment is up to 30 percent that an injured worker could recover.

So we typically contact the insurance company immediately when payments are late and ask them to put our clients on a payment program and if they consistently are late in their payments, we counsel our clients and file penalties claims. That is typically additional dollars that go into our client’s pocket, because after all, it’s tough to pay your bills when your income is in a state of flux and you can’t count on that check coming in, so we take those late payment claims very seriously.
