Well, I think one of the most oft repeated issues that I see in construction cases is timing issues.  Unlike, for example, medical malpractice, where you have what we call a statute of limitations of four years, in construction cases every single claim has its own statute of limitations.  So, it’s a very unique area.  So, negligence, breach of contract, breach of warranty.  They all have a different timing attached to them.  So, it makes it very complex to analyze them, and it makes it challenging.

So, that’s the issue I see the most in the cases, what we call statute of limitations issues.

Minneapolis Medical Malpractice and Civil Litigation Attorney, Kathleen Loucks, discusses the various issues that arise in construction law.
